1. Overview
These Terms of Service ("Terms") govern your access to and use of the Call Jesus mobile app, associated websites, and related services (collectively, the "Service"). The Service is operated by nftstory ltd., a company organized under the laws of the province of Quebec, Canada ("we", "us", or "our"). By installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
Call Jesus is not affiliated with, endorsed by, or officially connected to any church, denomination, or religious organization. The Service is independent from Apple Inc. and is not sponsored, endorsed, or approved by Apple. If you downloaded the app from the Apple App Store, you acknowledge that these Terms are between you and nftstory ltd., not Apple. Apple has no obligation to furnish any maintenance or support services for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
2. Description of the Service
Call Jesus is a subscription-supported app that lets you have real-time, voice-based conversations with an AI character configured to speak "as Jesus." You speak into your device; your audio is sent to our infrastructure and AI providers; the AI generates responses based on prompts we configure and returns them as audio; and we track your usage and entitlements.
The Service is experimental and intended for spiritual reflection, comfort, and devotional inspiration. It is not a literal conversation with the historical Jesus, God, or any spiritual being; not a substitute for professional advice (medical, mental health, legal, tax, financial, or otherwise); and not a substitute for pastoral care from human spiritual advisors.
3. Eligibility and acceptance
By using the Service you represent and warrant that you are either (a) at least 18 years old (or the age of majority in your jurisdiction, whichever is higher); or (b) at least 13 years old (or the minimum digital-consent age in your jurisdiction if higher) and using the Service with the consent and active supervision of a parent or legal guardian. Parents and legal guardians are responsible for their minor children's use of the Service and agree to be bound by these Terms on behalf of such minors.
4. Accounts, identity, and access
The Service uses a lightweight identity model: the app may generate or retrieve a device-level user identifier; if you sign in with Apple or another provider, we may receive an identifier and, where you allow it, your name and email; the backend primarily uses an opaque user ID. You are responsible for keeping your device and sign-in methods secure. We may change, suspend, or discontinue any part of the Service at any time and do not guarantee that the Service will always be available, error-free, or meet your expectations.
5. Subscriptions, credits, and payments
The Service may offer recurring subscriptions (e.g., weekly or monthly) and/or usage-based credit packs. Your ability to start or continue calls depends on your available usage. Purchases and renewals are handled by app stores and payment providers, under their own terms and refund policies. Subscriptions may auto-renew until you cancel through your app-store account settings. Canceling typically stops future renewals but does not refund the current period. We do not handle or store your full payment card details. We may change pricing in the future; changes generally apply going forward and will be communicated as required by law.
6. Acceptable use
You agree to use the Service only for lawful, personal, and non-commercial purposes and not to: violate any law or third-party rights; harass, threaten, abuse, or harm others, or promote violence, hate, or discrimination; intentionally encourage serious self-harm or harm to others; bypass or tamper with subscriptions, quotas, or usage limits; interfere with or disrupt the Service or attempt unauthorized access; reverse engineer or attempt to derive source code or underlying models, except where permitted by law; use the Service while driving or operating machinery; or present, publish, or represent any output from the Service as the literal words of Jesus or as professional or pastoral guidance. We may suspend or terminate access for violations.
7. Nature of the experience and key disclaimers
7.1 AI-generated content. All responses are generated by AI models configured with a Christ-centered prompt. The Service simulates a conversation "with Jesus"; it is not an actual communication with Jesus, God, or any spiritual being. AI outputs can be wrong, misleading, inconsistent, fabricated, or poorly suited to your situation, even if they sound confident or spiritually informed. AI outputs may be emotionally distressing or unsettling. The Service may produce unexpected religious content, including interpretations, language, or themes you may find unfamiliar, incorrect, or disagree with. Although we try to discourage medical, legal, tax, and financial directives in prompts, the models may still touch on these topics. You alone are responsible for how you interpret and act on what the Service says.
7.2 No professional advice. THE SERVICE DOES NOT PROVIDE MEDICAL OR MENTAL HEALTH ADVICE; LEGAL, TAX, OR FINANCIAL ADVICE; OR PROFESSIONAL COUNSELING OR THERAPY. Always seek advice from qualified professionals. Never delay, disregard, or stop seeking professional help because of something you heard through the Service.
7.3 Crisis and emergencies
If you are in crisis or danger, stop using Call Jesus and contact emergency services or a crisis line immediately. The Service is not an emergency response, crisis intervention, or suicide prevention service. It cannot detect, prevent, or respond to a crisis, and it cannot dispatch help.
If you are thinking about suicide or self-harm, are at risk of harming others, or are facing a medical or safety emergency, please contact a qualified human professional immediately. The following resources may help, depending on where you are:
- Canada & United States: 9-8-8 Suicide & Crisis Lifeline — call or text 988.
- United Kingdom & Ireland: Samaritans — call 116 123.
- Australia: Lifeline — call 13 11 14.
- France: 3114 (numéro national de prévention du suicide).
- European Union: 116 123 (free emotional support helpline available in many EU member states).
- Crisis Text Line (US/UK/Canada/Ireland): text HOME to 741741.
- Worldwide: find a local hotline at findahelpline.com.
- For any immediate threat to life: call your local emergency number (911 in the US/Canada, 112 in the EU/UK, 000 in Australia, or your local equivalent).
You agree not to rely on the Service in lieu of professional help, and you understand that any reliance is at your own risk. We expressly disclaim any duty to detect or respond to crisis content, and our suspension or termination decisions are not a substitute for professional crisis evaluation.
8. User content and data handling
During calls, your audio is transmitted and converted into text transcripts. We do not store raw call audio by default; we may store full or partial text transcripts; some transcripts may be reviewed by humans for safety and quality assurance; transcripts may be used to provide, analyze, and improve the Service and to monitor for misuse and technical issues. To the extent allowed by law, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and create derivative works from content you provide through the Service (including transcripts) only to provide and improve the Service. We do not license or sell your conversation content to third parties for their own independent products or advertising. If you send feedback or suggestions, we may use them without obligation to you.
9. Third-party services
The Service relies on third parties such as app stores, subscription-management services, real-time communication providers, AI providers, analytics, and hosting services. Your use of the Service may also be subject to their terms and privacy policies. We are not responsible for their services, except as required by law. Apple, the Apple logo, iPhone, and App Store are trademarks of Apple Inc.
10. Intellectual property
Except for content you provide, the Service (including design, text, logos, artwork, and code) is owned by us or our licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control and to access the Service for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works of the Service except as allowed by law.
11. Open-source and third-party code
The Service may include open-source and third-party components under their own licenses. These licenses govern your use of those components.
11a. Content sensitivity and acknowledgment of risk
You understand and agree that the Service is a simulation using an AI character configured to speak as Jesus. It is not a clergy member, pastor, spiritual director, theologian, prophet, or anyone of religious authority, and does not speak for any church, denomination, or religious tradition. AI outputs may be theologically incorrect, doctrinally inconsistent, or offensive to your specific tradition or beliefs. The output is not vetted by clergy or theologians and should not be treated as authoritative spiritual guidance. Conversations may surface emotionally distressing material, including (but not limited to) content related to suffering, death, judgment, sin, mental and physical illness, sexuality, abuse, or trauma. If at any point continued use feels harmful to your wellbeing, stop using it and seek qualified human support. You will not present, publish, share, or represent any output as the literal words of Jesus, as official religious teaching, or as professional advice. You will not use the Service to make irreversible, time-sensitive, medical, legal, financial, or major life decisions. You voluntarily assume the risks of using a generative-AI service for spiritual reflection.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We make no promise, guarantee, or warranty that the Service will be uninterrupted, secure, or error-free; that AI-generated content will be accurate, complete, doctrinally correct, or suitable for your circumstances; or that you will achieve any particular spiritual, emotional, or practical outcome. You use the Service at your own risk.
13. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service. Our total liability for any claim related to the Service or these Terms will not exceed the greater of: (a) the amount you paid to us for the Service in the three (3) months before the event giving rise to the claim; or (b) USD $50. Some jurisdictions do not allow certain limitations or exclusions; in those places, these limits apply only to the extent permitted by law.
14. Indemnification
You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
15. Changes to the Service and these Terms
We may modify or discontinue the Service and may update these Terms from time to time. When we make material changes we will update the "Last updated" date and may provide additional notice where appropriate. Your continued use after updated Terms take effect means you accept them.
16. Termination
You may stop using the Service at any time and may uninstall the app. If you cancel a subscription through your app-store account, you will usually keep access until the end of the current billing period. We may suspend or terminate your access at any time, with or without notice, including for violations or if providing the Service is no longer commercially or legally viable. Provisions that by their nature should survive (ownership, disclaimers, limitations of liability, indemnity) continue to apply.
17. Governing law and disputes
These Terms and any dispute related to them are governed by the laws of the province of Quebec and applicable federal laws of Canada, without regard to conflict-of-laws rules. Subject to applicable law, you and we submit to the exclusive jurisdiction of the courts located in Quebec for disputes arising out of or relating to these Terms or the Service. If mandatory consumer-protection laws in your region conflict with these Terms, those laws will prevail to the extent of the conflict.
17a. Region-specific consumer rights
Nothing in these Terms is intended to limit any non-waivable rights you may have under mandatory consumer-protection laws in your jurisdiction.
- Quebec residents. Nothing displaces your rights under the Quebec Consumer Protection Act, the Civil Code of Québec, or Law 25. You may bring proceedings before the courts of the district where you reside, as permitted by the CPA. Any provision of these Terms that would, under the CPA, be considered prohibited or unenforceable in a consumer contract does not apply to you.
- EU, EEA, and UK residents. Nothing limits any non-waivable consumer rights under EU, EEA, or UK consumer law, including statutory remedies, withdrawal rights, and the right to bring proceedings in your country of residence.
- California residents. California Civil Code § 1789.3 notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
- Australian residents. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
17b. Additional terms applicable to App Store distribution (Apple EULA pass-through)
If you obtained the app from Apple's App Store, the following additional terms apply:
- Acknowledgment. These Terms are between you and us only, not with Apple. We — not Apple — are solely responsible for the app and its content.
- Scope of license. The license is limited to a non-transferable license to use the app on any Apple-branded device that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms of Use.
- Maintenance and support. We — not Apple — are solely responsible for maintenance and support; Apple has no such obligation.
- Warranty. Apple has no warranty obligation. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. Any other warranty claims, losses, liabilities, damages, costs, or expenses are our sole responsibility.
- Product claims. Apple is not responsible for product liability, regulatory non-conformance, or consumer-protection / privacy claims.
- Intellectual property. In the event of any third-party IP claim against the app, we — not Apple — are solely responsible for investigation, defense, settlement, and discharge.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and not on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
- Developer contact. Questions, complaints, or claims about the app: support@calljesus.app.
18. Notices and electronic communications
You agree that we may communicate with you electronically (by email, in-app messages, or notices within the Service). Notices to us should be sent to support@calljesus.app.
19. Force majeure
We are not responsible for any delay, failure, or interruption of the Service resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, power failures, internet or telecommunications outages, governmental actions, or failures of third-party service providers.
20. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in whole or in part, including to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets.
21. Waiver, severability, entire agreement
Our failure to enforce any provision is not a waiver. If any provision is held invalid, that provision will be enforced to the maximum extent permitted by law and the rest will remain in force. These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding the Service and supersede prior agreements on that subject.
